Information on data protection during the job application process

Information according to article 13 of the General Data Protection Regulation (GDPR) for job application processes at Staatliche Hochschule für Gestaltung Karlsruhe.

3. Purpose and legal basis of the processing

If you decide to apply for a job with us, we will process your application data in order to contact you as well as to assess whether you have the qualifications and aptitude and fulfill the professional requirements for the position you are applying for. Selection processes at Staatliche Hochschule für Gestaltung Karlsruhe are carried out according to the requirements determined in section 33 subsection 2 of the German Basic Law (GG), the General Act on Equal Treatment (AGG), the Act on Higher Education of the Land of Baden-Württemberg (LHG), and budgetary law. The legal basis for data processing in the selection process for the justification of a civil servant/employment relationship is article 6 subsection 1(e) in conjunction with subsection 3 GDPR in conjunction with section 15 of the Data Protection Act of the Land of Baden-Württemberg (LDSG) in conjunction with sections 83 to 85 of the Act on Civil Servants of the Land of Baden-Württemberg (LGB).


4. Recipients of personal data

In case of applications for a professorship: Personal data contained in the application documents are given to the appointment committee, persons that have to be consulted by the appointment committee (reviewers, representatives for employees with disabilities), the responsible human resources managers as well as in part to the university bodies involved in the appointment procedure. In case of applications for other positions: Personal data contained in the application documents are given to the members of the selection committee of the department in question, the responsible human resources managers, as well as staff representatives (staff council, equal opportunities officer, representative for employees with disabilities, if applicable).


5. Storage period

You personal data/application documents will be destroyed within three months after receipt of a rejection, unless longer storage is necessary in order to defend legal claims. In case of successful application, your application documents will be further processed for purposes of the employment relationship.


6. Rights of the data subject

You have the right of access (article 15 GDPR), the right to rectification (article 16 GDPR), to erasure (article 17 GDPR), to restriction of processing (article 18 GDPR), to object (article 21 GDPR) as well as the right to data portability (article 20 GDPR). Furthermore, you have the right to lodge a complaint with a supervisory authority according to article 51 GDPR. In the Land of Baden-Württemberg, this is the commissioner for data protection and freedom of information of Baden-Württemberg.


7. Obligation to provide personal data

In order for the selection process to be carried out as required by law, applicants are required to provide the relevant personal data. Applicants who fail to provide the relevant personal data might not be considered for the position in question. Selection processes at [University X] are carried out according to the requirements determined in section 33 subsection 2 of the German Basic Law (GG), the General Act on Equal Treatment (AGG), the Act on Higher Education of the Land of Baden-Württemberg (LHG), and budgetary law, which dictate that candidates are selected based on qualifications, aptitude and professional requirements.
